Get StartedThe proposed ordinance is submitted to the voters of the Borough of Malvern in accordance with the provisions of the Borough's Home Rule Charter. The proposed ordinance applies to a parcel of land owned by the Borough, having an area of approximately 0.847 acres, located off of Ruthland Avenue and adjacent to the property of the Malvern Fire Department, hereinafter referred to as ""Subject Parcel."" If adopted, the ordinance would extend the area of an existing easement to the Subject Parcel, granting a perpetual conservation easement over the Subject Parcel, and designating the Subject Parcel for publicly accessible passive recreation and open space activities. Passive recreation and open space activities are only those activities that can be carried out with little or no alteration or disruption to the natural features of the land on which they take place and which serve to preserve, restore, enhance, or maintain habitat areas for native flora and fauna. The easement would limit the following activities or uses of the Subject Parcel: operation of pedalcycles or construction of a bike path or ""pump park,"" as well as the limitations contained in the original easement on the use of motorized vehicles, construction, use of chemical and biological additives, disturbance of soil, signage, quarrying and excavation, groundwater removal, actions affecting streams and wetlands, dumping, and tree cutting.
A ""yes"" vote approves the enactment of the proposed ordinance.
A ""no"" vote disapproves the enactment of the proposed ordinance.
Shall the ordinance entitled ""An Ordinance Offering a Conservation Easement and Declaration of Restrictive Covenants to the Willistown Conservation Trust, Inc., for Certain Borough-owned Property in the Ruthland Avenue – Randolph Woods Tract"" be adopted granting a conservation easement to the Willistown Conservation Trust, Inc., for the purpose of preserving a 0.847-acre tract of land owned by the Borough, off of Ruthland Avenue and adjacent to the Malvern Fire Department property?
