Question 9 - Proposed Charter Amendment

Shall Section 3.12 of the Charter of the City of Elyria be amended as follows? A Council member's resignation must be in writing to the Clerk of Council and shall be effective upon adjournment of the next regular Council meeting. A vacating member's seat shall be filled by an appointee of the same political party as the vacating member, except that if the vacating member has no political party affiliation, then the appointee shall likewise have no political party affiliation. If no other members of Council share the same party affiliation as the vacating member, then all remaining members of Council shall vote to select the replacement. Council must fill said vacancy within 45 days of its occurrence. If Council fails to fill the vacancy in 45 days, the Mayor shall fill it by appointment.
